Scope; Applicability to you.

Press Ganey’s services offer its customers an integrated solution to collect and analyze patient, workforce member, and customer feedback. As part of our services, our customers (typically either your health care provider, employer, or other company that is Press Ganey’s direct customer) may share your information with us for Press Ganey to contact you about your experiences. When we are collecting information from you on behalf of our customers, we will only collect, use, and otherwise process your personal information as directed by our customers. Accordingly, this Privacy Policy does not apply to the extent we process Personal Data in the role of a data processor on behalf of our customers.

To this end, if you have received a survey from Press Ganey on behalf of your health care provider, employer, or other company that is Press Ganey’s direct customer, this Privacy Policy does not apply to your information. For detailed privacy information related to when we process your information on behalf of a Press Ganey customer, or if you need to access or delete any personal data we may have collected from you as permitted by applicable law, please reach out to the respective customer directly. If you are unsure what customer directed us to collect information on their behalf from you, please consult the survey invitation you received that directed you to our services. We are not responsible for the privacy or data security practices of our customers, which may differ from those set forth in this Privacy Policy.

If you are personnel of a Press Ganey customer who is using the site to review, analyze, or otherwise process survey responses in your professional role, or who utilizes Press Ganey online tools, this privacy policy does not apply to you. In such a case, we only collect business related information from you (i.e., email and username), and we do not use, share, or otherwise process any of your personal information except to perform our services or as otherwise set forth in the agreement between you and your employer. Accordingly, for detailed privacy information related to your use of the Site when receiving or using our services, or if you need to access or delete any personal data we may have collected from you as permitted by applicable law or the agreement between us and our customer, please reach out to your employer directly.

In the event that Press Ganey is not acting as a data processor, and your personal information is not otherwise excluded as set forth above, the following information applies to how we, collect, use, and share your personal information, e.g. via the website.

Third Party Sites. Our Site also contains links to third party sites that are not owned or controlled by Press Ganey. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.

Information that we collect

Generally. We collect several types of information from and about users of our Site (“Personal Data”):

  • by which you may be personally identified, such as name, e-mail address, telephone number, account ID or username, and any other identifier by which you may be contacted online or offline;
  • that is about you but individually does not identify you, such as traffic data, location data, logs, referring/exit pages, date and time of your visit to our Site, error information, clickstream data, and other communication data and the resources that you access and use on the Site; and/or
  • about your internet connection, the equipment you use to access our Site and usage details.

We collect this information:

  • directly from you when you provide it to us;

Information You Provide to Us. The information we collect on or through our Site are:

  • information that you provide by filling in forms on our Site. This includes information provided at the time of registering to use our Site, using our services, or requesting further services or information. We may also ask you for information when you report a problem with our Site; and
  • records and copies of your correspondence (including email addresses) if you contact us.

You also may provide information to transmit to other users of the Site or third parties (collectively, “User Messages”). Your User Messages are transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Therefore, we cannot and do not guarantee that your User Messages will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies. As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns:

  • that is about you but individually does not identify you, such as traffic data, location data, logs, referring/exit pages, date and time of your visit to our Site, error information, clickstream data, and other communication data and the resources that you access and use on the Site; and/or

We and our service providers on our behalf use cookies, web beacons, and other technologies to receive and store certain types of information whenever you interact with our Site through your computer or mobile device. No Information from Children Under Age 18

Our Site is not intended for children under 18 years of age. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not use or provide any information on our Site, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. How we use and share your information

To Provide Products, Services, and Information. We use information that we collect about you or that you provide to us, including any Personal Data:

  • to fulfill or meet the reason you provided the information.
  • to provide, support, personalize, and develop our Website, products, and services.
  • to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • to help maintain the safety, security, quality, and integrity of our Website, products and services, databases and other technology assets, and business, including to detect security incidents, protect

against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, and to debug to identify and repair errors that impair existing intended functionality.

  • to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Press Ganey’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Press Ganey about our Website users is among the assets transferred.in any other way we may describe when you provide the information; and

With your consent, we may also use your information to contact you about our own goods and services that may be of interest to you. If you wish to consent to this use, please reach out through the Contact Us link. By completing and submitting the contact form you consent to Press Ganey contacting you about its goods and services. If you wish to change your choice, you may do so at any time by sending us an email stating your request at privacy@pressganey.com.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Data for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Sharing with Third Parties. We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Policy. However, we may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose Personal Data that we collect or you provide as described in this Privacy Policy:

  • to contractors, service providers, and other third parties we use to support our business. These entities provide IT, marketing, and infrastructure support services;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Press Ganey’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Press Ganey about our Site’s users is among the assets transferred;

We may also disclose your Personal Data:

Access to your information and choices

You can review and change your Personal Data by notifying us through the contact information below, or through the live chat feature of our Site, of any changes or errors in any Personal Data we have about you to

ensure that it is complete, accurate, and as current as possible or to delete your account. We cannot delete your personal information except by also deleting your account with us. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

In addition, we strive to provide you with choices regarding the Personal Data you provide to us. We have created mechanisms to provide you with control over your Personal Data:

  • Promotional Offers. If you do not wish to have your email address used by Press Ganey to promote our own products and services, you can opt-out at any time by clicking the unsubscribe link at the bottom of any email or other marketing communications you receive from us or by contacting us using the contact information below.
  • Tracking Technologies and Advertising. We also may use automated data collection technologies to collect information about your online activities over time. Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us. However, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

As described above, we may also process Personal Data submitted by or for a customer to our cloud products and services. To this end, if not stated otherwise in this Privacy Policy or in a separate disclosure, we process such Personal Data in the role of a mere processor on behalf of a customer (and/or its affiliates) who is the responsible controller of the Personal Data concerned. We are not responsible for and have no control over the privacy and data security practices of our customers, which may differ from those set forth in this Privacy Policy. If your data has been submitted to us by or on behalf of a Press Ganey customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with the applicable customer directly. We will support them as needed in responding to your request within a reasonable timeframe.

We do not control the collection and use of your information collected by third parties. When possible, these organizations are under contractual obligation to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.

Security of your information

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Site. Any transmission of Personal Data is at your own risk. This Site and Services are not intended for and are not directed to residents of the European Union.     3. Right to Request Deletion of PII. Individuals have the right to request that Press Ganey delete any PII about the consumer that Press Ganey has collected or that Press Ganey maintains. Please note that there are exceptions to this deletion right, such as the information Press Ganey needs to keep complying with the CCPA, that is permitted to be retained under the CCPA, or is required or permitted to be retained under other applicable laws.
    4. Right to Not Be Discriminated Against. Individuals have the right not to receive discriminatory treatment from Press Ganey for the exercise of the privacy rights conferred by CCPA and listed in this State Privacy Compliance Policy.

      If individuals make a request to Press Ganey under this policy, Press Ganey is required to verify individual identity before complying with the request.
  2. Right to Opt Out. Individuals have the right to opt out of Press Ganey sales of PII to third parties.

This EU Privacy Notice supplements the Press Ganey general privacy policy and sets forth additional information applicable to EU residents.

This Press Ganey EU UK Privacy Notice (“Notice”) supplements the information contained in Press Ganey Associates LLC (“Press Ganey,” “we,” “our,” or “us”) Privacy Policy (“Privacy Policy”) and applies solely to all visitors, users, and others who reside in the EU or UK (“you”). We adopt this Notice to comply with the EU’s General Data Protection Regulation 2016/679 (“GDPR”) and the UK’s Data Protection Act 2018 (“UK DPA”). Any terms not defined in this Notice will have the meaning set forth in our Privacy Policy or as defined by the GDPR and/or UK DPA when used in this Notice. Generally, Press Ganey serves as a data processor for customers who direct us to collect Personal Data on their behalf. For background, Press Ganey offers its customers an integrated solution to collect and analyze patient, workforce member, and customer feedback. As part of our services, our customers (typically either your health care provider, employer, or other company that is Press Ganey’s direct customer) may share your information with us for Press Ganey to contact you about your experiences. When we are collecting information from you on behalf of our customers, we are acting as a data processor, and we will only collect, use, and otherwise process your Personal Data as directed by our customers.

To this end, if you have received a survey from Press Ganey on behalf of your health care provider, employer, or other company that is Press Ganey’s direct customer, this Notice does not apply to your information. For detailed privacy information related to when we process your information on behalf of a Press Ganey customer, or if you would like to request or exercise any of your rights under applicable law for any Personal Data we may have collected from you, please reach out to the respective customer directly. If you are unsure what customer directed us to collect information on their behalf from you, please consult the survey invitation you received that directed you to our services. Because we may only access a customer’s data upon instruction from that customer, if you wish to make your request directly to us, please provide to us the name of the Press Ganey customer who submitted your data to us. We will refer your request to that customer and will support them as needed in responding to your request within a reasonable timeframe. We are not responsible for the privacy or data security practices of our customers, which may differ from those set forth in this Notice and our Privacy Policy.

If you are personnel of a Press Ganey customer who is using the site to review, analyze, or otherwise process survey responses in your professional role, or to access Press Ganey’s online tools, this privacy policy does not apply to you because we are serving as a processor as well. In such a case, we only collect business related information from you (i.e., email and username), and we do not use, share, or otherwise process any of your Personal Data except to perform our services or as otherwise set forth in the agreement between you and your employer. Accordingly, for detailed privacy information related to your use of the Site when receiving or using our services, or if you would like to request or exercise any of your rights under applicable law for any Personal Data we may have collected from you, please reach out to your employer directly.

We process Personal Data only when we have a lawful basis to do so, such as permitted by a data processing agreement with our customers, with your consent, as necessary for our legitimate interests, or as otherwise required or permitted by law. Your Personal Data will only be transferred outside of the European Economic Area, and the UK, including to the United States, when it is legally permissible to do so.

You have certain rights relating to your Personal Data, subject to local data protection laws. These rights may include:

We reserve the right to limit or deny your request if you have failed to provide sufficient information to verify your identity or to satisfy our legal and business requirements.

We will hold all Personal Data for so long as we have an obligation to our customer to provide the services to them, and thereafter until such time as set forth in our customer agreement or upon a valid deletion request. If you have questions about the above, have any request to modify your data to make it as accurate or up to date as possible, or for any other questions in regard to this Notice, please contact our Privacy Officer using the information below. Individuals may also complain to a relevant supervisory authority; however, we request that you kindly contact us first so we can attempt to resolve the issue.
